1. Scope
These General Terms and Conditions (hereinafter "GTC") of Online Trade Marketing Ltd. (hoteldealer24 - is a product of Online Trade Marketing Ltd), hereinafter "Seller" / "Agent" / "Provider", apply to all contracts for the delivery of goods in this shop as well as our social media channels and advertising platforms such as Facebook, Instagram, as well as the advertising platforms we use such as Pinterest, third-party platforms & affiliate platforms such as digistore24. Consumers (§ 13 BGB) or entrepreneurs, hereinafter "Buyer" / "Customer", conclude with the Seller regarding the goods presented by the Seller in his online shop. The inclusion of the Customer's own terms and conditions is hereby contradicted, unless otherwise agreed. The shop operator/provider offers digital hotel vouchers, travel agencies and affiliate links to partner offers.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.
1.3 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.

3. Services of the provider / Services of the service provider
a) Digital hotel voucher codes
The hotel vouchers offered in the form of digital voucher codes entitle you to book certain hotel services according to the terms and conditions specified in the respective product. Redemption takes place directly with the respective hotel or service provider. Additional terms and conditions of the service provider may apply*.
Bonus / Extra: As our customer, you generally choose from the entire portfolio of the service provider. This also applies to items/hotel voucher codes advertised under regions/destinations/themes/travel destinations. There is no separate hotel overview specifically for this item/hotel voucher code, based on
the topic, the destination, the travel destination and/or the region.
*For some of our offers, the service provider is WCS – which stands for World Consulting Service Ltd Inc., 2701 Centerville Road, Wilmington, DE, 19808 USA. If WCS* is the service provider, this will be indicated accordingly.
WCS* products generally include the following services, which you accept with these Terms and Conditions:
- 3 hotel nights: EUR 299,- €² (= retail price of the service provider WCS*)
- 7 hotel nights: EUR 599,- €² (= retail price of the service provider WCS*)
- 14 hotel nights: EUR 999,- €² (= retail price of the service provider WCS*)
- 365-day annual pass: EUR 1,999.00² (= retail price of the service provider WCS*)
- The voucher code is neutral/transferable until registration and is valid for at least 5 years from the date of registration by the holder (except for the 365-day annual pass, which is valid for 365 days from registration), making it an ideal gift.
- After payment has been received, you will receive your digital voucher code conveniently via email for download. You can then select and book your desired hotel and destination from the service provider's* entire portfolio. As our customers, you can choose from the entire WCS* portfolio. There are currently two hotel databases available, each with different booking functions. You can preview them here: Hotel Overview A and Hotel Overview B.
- Complete travel flexibility: Decide for yourself how you want to split the respective hotel stays (3, 7, 14, or 365 days, depending on the product) within the validity period and subject to availability for a period of 5 years. Example: 3 hotel stays: 1 x 3 nights in one hotel or 3 x 1 night in different hotels, etc. ... or buy multiple vouchers and combine them, e.g., to extend your trip or to travel with other people...
- Shipping / Delivery: We do not charge any shipping or handling fees. You will receive the item (= digital hotel voucher code) via email for secure download immediately after purchase.
- Hotel bookings are subject to availability and can only be made through the booking system of the service provider WCS*. The terms of use of the service provider WCS* apply.
- Not suitable for short-term bookings; booking lead time is 10 days to 4 weeks, depending on offer and availability.
- Self-drive travel, i.e. the costs for your arrival and departure (e.g. by train, plane, car, etc.) are not included.
- The offer includes 3, 7, 14 or 365 hotel nights (depending on which product you have chosen) for 2 people in a double room, or in the annual pass for the whole family, the additional costs for the obligatory meal plan (usually breakfast and dinner) are not included (varies depending on the hotel selection and hotel category, currently starts at around 30.00 euros per person/per day, with the exception of special offers, see FAQ in the respective product description on our website hoteldealer24.de ).
- Cash payment/offering of the voucher value is not possible.
- Leisure and entertainment programs offered by the hotels, as well as on-site sports and leisure facilities (such as pools, saunas, fitness centers, etc.), are often included. In addition, many hotels offer great additional services on-site upon request, such as wellness, massages, childcare, courses, excursions, etc.
b) Affiliate links & advertising
Parts of the shop and our social media channels use affiliate links to third-party providers. Clicking on such links and booking/purchasing through the third-party provider may result in a commission being paid to the provider. The actual contract is concluded exclusively between you and the third-party provider. This does not incur any additional costs for you. Such links and content are marked accordingly.
c) Provision of tourist services such as travel agencies
To the extent the provider acts as a (travel) agent, the arrangement of package tours, accommodations, or other travel services is carried out in the name and on behalf of the respective tour operator or service provider. The general terms and conditions of the respective provider apply. The provider itself is not a tour operator within the meaning of Section 651a of the German Civil Code (BGB).
d) Use of affiliate links on social media platforms
(e.g. Instagram, Facebook, Pinterest), through which a commission can flow to us when you click on a link and subsequently book/purchase.
Supplement to a), b), c) and d)
Online Trade Marketing Ltd. markets digital hotel vouchers (online voucher codes), remaining, special, and capacity bookings, particularly for tourism and leisure-related services/service providers, among others, on behalf of the respective service provider/service provider as their commission agent. In relation to the end customer/consumer/customer, Online Trade Marketing Ltd. acts only as an intermediary; the contract for the services themselves is concluded with the respective service provider. Information about the services offered is based on the information provided by the respective service providers to Online Trade Marketing Ltd. and does not constitute a representation or guarantee by Online Trade Marketing Ltd.
Services owed by Online Trade Marketing Ltd.
In its function as an intermediary, Online Trade Marketing Ltd. owes the customer only the proper mediation of the contract, not the mediated service itself. A contract for agency services pursuant to Sections 675 and 631 of the German Civil Code (BGB) is concluded between Online Trade Marketing Ltd. and the customer. §3
4. Conclusion of contract
4.1 Direct purchase of the seller's/provider's own products
The presentation of products in the Shopify store does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Buy now" button, you place a binding order. Confirmation of receipt of the order is automated and does not constitute acceptance. The contract is only concluded upon receipt of a separate order confirmation via email.
4.1.a) The customer can submit the offer via the online order form integrated into the seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contractual offer for the goods contained in the shopping cart by clicking the button that completes the ordering process.
4.1.a) If a payment method offered by PayPal is selected, payment processing will be carried out via the payment service provider PayPal (Europe) S. à r. l. et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), subject to the PayPal Terms of Use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or - if the customer does not have a PayPal account - subject to the terms and conditions for payments without a PayPal account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full . If the customer pays using a payment method offered by PayPal that can be selected during the online ordering process, the seller hereby declares acceptance of the customer's offer at the time the customer clicks the button that completes the ordering process.
4.1.b) When submitting an offer via the seller's online order form, the contract text will be saved by the seller after the contract has been concluded and sent to the customer in text form (e.g., by email, fax, or letter) after the order has been sent. The seller will not make the contract text available beyond this time. If the customer has created a user account in the seller's online shop before submitting their order, the order data will be archived on the seller's website and can be accessed free of charge by the customer via their password-protected user account by entering the corresponding login data.
4.1.c) Before submitting a binding order via the seller's online order form, the customer can identify possible input errors by carefully reading the information displayed on the screen. An effective technical means for better detecting input errors can be the browser's zoom function. During the electronic ordering process, the customer can correct their entries using the usual keyboard and mouse functions until they click the button that completes the order process.
4.1.d) For the conclusion of the contract, the German language is primarily available; if different languages are available, the specific language selection will be displayed in the online shop.
4.1.e) Order processing and contact are generally carried out via email and automated order processing. The customer must ensure that the email address provided for order processing is correct, so that emails sent by the seller can be received at this address. In particular, when using spam filters, the customer must ensure that all emails sent by the seller or third parties commissioned by the seller to process the order can be delivered.
4.2 Purchase when the seller acts as an agent / affiliate
4.2.a) The broker provides the customer with various advertising links or banners on its website, which redirect the customer to the offers of the respective providers with a mouse click. The provision of these advertising links or banners constitutes a binding offer by the broker to conclude a brokerage agreement, which the customer can accept by clicking on the respective advertising link or banner.
4.2.b) The contract text regarding the brokerage is neither stored by the broker nor is it accessible to the customer after the customer has submitted his/her contractual declaration.
4.3 For the conclusion of the contract, the German language is primarily available; if different languages are available, the specific language selection will be displayed in the online shop.
5. Failure to perform when the seller acts as an agent/affiliate
5.1 For any failure to perform in connection with the brokerage of contracts in the relationship between the agent and the customer, the agent shall be liable to the customer in accordance with the statutory provisions.
5.2 The agent is not liable for any breaches of the main contract between the customer and the provider. Claims for breaches of the main contract must be asserted by the customer directly against the respective provider.
6. Prices and payment terms
6.1 When purchasing the seller’s/provider’s own products directly
6.1.a Unless otherwise stated in the seller's product description, the prices quoted are total prices, including statutory VAT. Any additional delivery and shipping costs will be stated separately in the respective product description.
6.1.b For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the seller is not responsible and which must be borne by the customer. These include, for example, costs for money transfers through credit institutions (e.g., transfer fees, exchange rate fees) or import duties or taxes (e.g., customs duties). Such costs may also arise in relation to money transfers if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.
6.1.c The payment option(s) will be communicated to the customer in the seller’s online shop.
6.1.d If a payment method offered via the "Shopify Payments" payment service is selected, payment processing will be carried out by the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland ("Stripe"). The individual payment methods offered via Shopify Payments will be communicated to the customer in the seller's online shop. Stripe may use other payment services to process payments, for which special payment terms may apply, to which the customer may be informed separately. Further information on "Shopify Payments" can be found online at https://www.shopify.com/legal/terms-payments-de .
6.2 If the seller acts as an agent / affiliate
6.2.a Unless otherwise stated in the product description of the seller and/or third-party provider, the prices quoted are total prices that include statutory VAT. Any additional delivery and shipping costs will be stated separately in the respective product description of the third-party provider.
Order and payment processing is handled by a third-party provider and/or service provider (affiliate program/affiliate platform/travel booking tool, etc.), such as the payment service provider DigiStore24 GmbH (St.-Godehard-Str. 32, 31139 Hildesheim, Germany). When using one of our third-party offerings, such as DigiStore24's affiliate offers, the terms and conditions and privacy policy of the respective provider/service provider, such as DigiStore24, also apply. These are displayed during the ordering process. In this case, the contract is concluded directly with DigiStore24 as the reseller, which sells the service in its own name and for its own account.
Delivery or provision will only take place after full payment has been received.
7. Remuneration if the seller acts as an agent / affiliate
The brokerage of the main contract is free of charge for the customer. Any costs incurred by the customer through the brokered main contract will be communicated to the customer in the respective provider's offer and, in the event of a contract being concluded, will be billed directly by the provider to the customer. In this respect, the statutory provisions governing the relationship between customer and provider, as well as any deviating contractual terms and conditions of the respective provider, apply.
8. Right of withdrawal
8.1 Consumers are generally entitled to a right of withdrawal, provided that this right is valid (detailed information on the right of withdrawal can be found in our cancellation policy / our cancellation conditions here on this page at: www.hoteldealer24.de/widerrufsbelehrung !).
For digital content (such as hotel voucher codes) that is not delivered on a physical data carrier, the right of withdrawal expires as soon as the execution of the contract/service has begun (e.g. by registering the hotel voucher code) and you have expressly agreed that you will lose your right of withdrawal upon commencement of execution (Section 356 (5) of the German Civil Code).

8.3 In the case of mediated services (e.g. travel or third-party providers), the right of withdrawal may be excluded if the service is a tourist service with a fixed date (Section 312g Paragraph 2 No. 9 of the German Civil Code).
9. Delivery and shipping conditions
5.1 Our items, such as digital hotel vouchers/hotel voucher codes, are delivered either by email and/or as an instant download after payment has been received. You are responsible for providing a correct email address during the ordering process and ensuring receipt.
5.2 We do not charge any shipping and handling fees; you will receive the item (unless otherwise stated in the respective item/service description) as agreed (as stated in the respective item/service description) exclusively either by email and/or as an instant download.
5.3 Self-collection is not possible for logistical reasons.
10. Liability for defects / Warranty
The seller is liable to the customer for all contractual, quasi-contractual and statutory claims, including tortious claims, for damages and reimbursement of expenses as follows:
10.1 The Seller shall be liable without limitation for any legal reason
– in case of intent or gross negligence,
– in the event of intentional or negligent injury to life, body or health,
– based on a guarantee promise, unless otherwise agreed,
– due to mandatory liability such as under the Product Liability Act.
10.2 If the Seller negligently breaches a material contractual obligation, liability is limited to the typical, foreseeable damages under the contract, unless unlimited liability applies in accordance with the above clause. Material contractual obligations are obligations that the contract imposes on the Seller according to its content to achieve the purpose of the contract, the fulfillment of which makes the proper execution of the contract possible in the first place, and on whose compliance the Customer may regularly rely.
The services offered by Online Trade Marketing Ltd. through third-party providers (such as affiliate offers, travel agencies, etc.) are exclusively brokerage services. The contract is concluded in the name and on behalf of the service providers. All claims for damages can only be asserted against them. Online Trade Marketing Ltd. is not liable for any disruptions or for force majeure, such as war, strikes, earthquakes, volcanic eruptions, severe weather, assassinations, etc. Liability is also excluded for natural or local circumstances.
Online Trade Marketing Ltd. is responsible for ensuring that the placement is carried out with the due care of a prudent businessman. This advertisement was prepared to the best of our knowledge and belief, based on the information provided by the third-party provider. The descriptions and photos of the services/offers/objects originate from the service provider/third-party provider. Online Trade Marketing Ltd. assumes no liability for discrepancies or the accuracy of the information. Justified or legally valid claims for damages can only be asserted against the service provider.
10.3 Otherwise, the Seller’s liability is excluded.
10.4 The above liability provisions also apply with regard to the Seller’s liability for its vicarious agents and legal representatives.
Online Trade Marketing Ltd. assumes no liability, and no claims for damages can be asserted. If use is not possible due to force majeure and no alternative is available, liability is limited to the amount of payments already made by the customer. In this case, no liability is assumed, provided the damage was caused neither intentionally nor through gross negligence. Online Trade Marketing Ltd. also expressly points out that the customer must exercise the utmost care, particularly in supervising accompanying children.
11. Redemption of promotional vouchers
11.1 Vouchers issued free of charge by the Seller as part of promotional campaigns with a specific period of validity and which cannot be purchased by the Customer (hereinafter "promotional vouchers") can only be redeemed as described in the service description of the respective promotional voucher and only within the specified period.
11.2 Individual products may be excluded from the voucher promotion if a corresponding restriction arises from the content of the promotional voucher.
11.3 Some promotional vouchers can only be redeemed before completing the order process. Subsequent settlement is not possible. Please refer to the relevant promotional voucher description for details on when and how you can redeem a promotional voucher.
11.4 The balance of a promotional voucher will not be paid out in cash or bear interest.
11.5 The promotional voucher will not be refunded if the customer returns the goods paid for in whole or in part with the promotional voucher within the scope of his statutory right of withdrawal.
11.6 The promotional voucher is transferable. The seller may discharge the respective holder's obligations by making a payment to the respective holder who redeems the promotional voucher in the seller's online shop. This shall not apply if the seller has knowledge or grossly negligent ignorance of the respective holder's ineligibility, incapacity, or lack of authority to represent the respective holder.
12. Copyrights, rights of use & other
All digital content provided (e.g., vouchers, images, texts) is subject to copyright. Reproduction or distribution to third parties is prohibited without express written consent.

13. Applicable law
13.1 Any contract between Online Trade Marketing Ltd and the customer shall be governed exclusively by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law shall apply to consumers only to the extent that it does not restrict mandatory legal provisions of the state in which they have their domicile or habitual residence. For consumers, this choice of law shall apply only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence. For contracts between the customer and a third-party provider (e.g., service provider, tour operator, etc.), the latter's general terms and conditions shall apply exclusively.
13.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or related to the brokerage agreement shall be Cologne. Should individual provisions of these General Terms and Conditions be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
14. Place of jurisdiction
If the customer is a merchant, a legal entity under public law, or a special fund under public law with its registered office in the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract shall be the seller's registered office. If the customer is based outside the Federal Republic of Germany, the seller's registered office shall be the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer's professional or commercial activity. In the above cases, however, the seller is entitled in any case to bring the dispute before the court at the customer's registered office.
15. Alternative dispute resolution
The seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
16. Notes / Conclusion
16.1 Resale, trading, or similar transactions with items purchased from us are expressly prohibited without the prior written consent of Online Trade Marketing Ltd.
16.2 The language for declarations by the user and New Media Supporters Operating GmbH is generally German.
16.3 All information has been compiled with the utmost care. However, no liability can be accepted for any errors in data entry or transmission. Online Trade Marketing Ltd. therefore assumes no liability for the accuracy, completeness, or timeliness of the content provided. In particular, information regarding prices and availability is the sole responsibility of the service providers; in this respect, the customer releases Online Trade Marketing Ltd. from any liability in connection with information provided by the service provider. This also applies to incorrect information provided by the service provider, which could, for example, lead to overbooking. With regard to the brokered services, Online Trade Marketing Ltd. is not liable for the service provision by the service provider, but only for the proper brokerage of the service and the proper transmission of the service provider's information to the customer.
16.4 General booking information for tourist services such as hotel voucher codes: Digital hotel voucher codes and hotel vouchers, for example, often involve a limited special quota. It is possible that this quota is fully booked for a desired period or that certain periods (e.g., trade fairs, holidays, etc.) are excluded from booking, even if available hotel capacity may be available on other sales platforms and/or reservation systems. The terms of use of the respective service provider generally apply.
16.5 We strive to ensure uninterrupted availability of the website at all times, but cannot guarantee this. Maintenance work, security or capacity reasons, as well as events beyond our control, may lead to temporary disruptions.
